Welcome
Thank you for purchasing Love Your Spine.
Please read these Terms and Conditions before purchasing or accessing the programme. They explain what you are buying, how access works, your rights and responsibilities, and my responsibilities as the provider.
If anything is unclear, please contact me at info@movewithscoliosis.com before purchasing.
1. Who We Are
“I”, “me” or “my” means Marie Christine Jaureguiberry, trading as Move with Scoliosis.
“You” or “your” means the person purchasing or using Love Your Spine.
I am a sole trader operating from:
3 Foxglove Close, Chertsey, Surrey, KT16 8FD, United Kingdom.
2. About Love Your Spine
Love Your Spine is a self-paced 21-day online movement programme designed with scoliosis and spinal fusion in mind.
The programme includes:
- 21 days of structured guidance
- pre-recorded movement tutorials
- three guided movement practices
- rest and relaxation practices
- downloadable practice sheets
- a downloadable 21-day tracker
- supporting programme emails
The programme is delivered online through the Move with Scoliosis member platform.
Love Your Spine provides general educational and movement content. It is not individually prescribed to your particular spinal curve, medical history or individual needs.
3. Access to the Programme
You will receive access to Love Your Spine following purchase.
The programme is designed to be completed progressively, so later lessons or modules may become available as you complete the preceding content.
Standard access
If you purchase standard access, you will receive 90 days of online access from the date of purchase.
You can choose when to begin your 21-day programme by clicking Start My 21 Days.
Your 90-day access period begins on the date of purchase, not on the date you click Start My 21 Days.
Starting the programme does not extend your access period.
If you start fewer than 21 days before your access expires, you may not have enough remaining time to complete the full programme.
At the end of the 90-day period, your online access will end automatically.
Any downloadable materials that you have legitimately downloaded during your access period may continue to be used by you for your own personal use.
4. Lifetime Access
If you purchase Lifetime Access, your access to Love Your Spine does not expire after 90 days.
For the purposes of these Terms, Lifetime Access means access for the lifetime of the Love Your Spine product while it continues to be offered and hosted by Move with Scoliosis.
It does not mean access for the natural lifetime of the purchaser and does not guarantee that the programme, its hosting platform or Move with Scoliosis will operate indefinitely.
If Love Your Spine is permanently discontinued, I will aim to give Lifetime Access customers reasonable advance notice where practicable. Where possible, I will also give you an opportunity to retain any downloadable materials that form part of the programme.
Lifetime Access applies to Love Your Spine and the materials included within that product. It does not automatically include:
- future courses
- SHINE membership
- coaching or 1:1 services
- live classes or workshops
- other future paid products
unless I expressly state otherwise.
5. Completing the Programme
Love Your Spine is structured as a 21-day programme, but you do not need to complete the days consecutively.
If you miss a day, you can simply continue where you left off. There is no need to restart or complete two days at once.
The supporting emails are intended to help you move through the programme. The online programme itself is the main source of the course content.
If you have standard 90-day access, you are responsible for beginning the programme early enough to complete it before your access expires if completing all 21 days is important to you.
6. Price and Payment
The price you pay is the price clearly displayed at checkout at the time of purchase.
Payment is required in full at the time of purchase.
Prices include VAT where applicable.
Love Your Spine is a one-off purchase and does not automatically renew.
If Lifetime Access is available as an additional purchase or upgrade, the additional charge and total amount payable will be shown before you confirm payment.
7. Your Right to Cancel and Immediate Digital Access
Love Your Spine is digital content supplied online.
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, consumers normally have a 14-day cancellation period for online contracts.
However, digital content can be supplied during that period where you:
- expressly consent to supply beginning before the end of the 14-day cancellation period; and
- acknowledge that you will lose your right to cancel once supply of the digital content begins.
If you give that consent and acknowledgement and I then provide access to Love Your Spine, your statutory 14-day cancellation right in relation to that digital content ends once supply begins. Legislation.gov.uk
Your consent and acknowledgement should be given before purchase and will be confirmed to you as part of your order confirmation or other confirmation that you can retain. UK distance-contract rules also require confirmation of the contract on a durable medium. Legislation.gov.uk
If, for any reason, immediate supply has not validly begun in accordance with those requirements, any statutory cancellation rights you have remain unaffected.
To contact me about a cancellation or refund, email:
Faulty or misdescribed digital content
The loss of the 14-day cancellation right does not remove your statutory rights if the digital content is faulty, is not of satisfactory quality, is not fit for a particular purpose where the law requires it to be, or does not match its description.
Those rights and remedies are protected by the Consumer Rights Act 2015 and cannot simply be excluded by these Terms. Legislation.gov.uk
8. Health and Exercise Disclaimer
Love Your Spine provides general movement and educational content.
It is not:
- medical treatment
- physiotherapy
- diagnosis
- individually prescribed rehabilitation
I am a qualified yoga and Pilates teacher with specialist training in scoliosis. Through this programme, I am providing movement education and guidance rather than medical treatment.
Exercise and physical activity involve some inherent risk.
You are responsible for deciding whether participation is appropriate for you and for working within your own abilities.
Do not push through pain.
If a movement does not feel right for you, stop, make the movement smaller, use an alternative where one is offered, or leave the movement out.
If you have an injury, recent surgery, significant or unexplained pain, a medical condition, concerns about exercising, or have been advised to seek medical guidance before exercising, please consult an appropriately qualified healthcare professional before starting or continuing the programme.
If your health circumstances change while using Love Your Spine, you should reconsider whether participation remains appropriate and seek professional advice where necessary.
9. Results
Bodies and circumstances vary, and no particular physical result can be guaranteed.
I do not guarantee that Love Your Spine will:
- reduce or eliminate pain
- correct or reduce a scoliosis curve
- prevent scoliosis progression
- change your posture
- produce any particular medical or physical outcome
Love Your Spine is designed to provide structured movement guidance and opportunities to develop strength, movement awareness, understanding and confidence.
Your experience will depend on your individual circumstances and how you use the programme.
10. Intellectual Property and Personal Use
All Love Your Spine videos, recordings, written materials, practice sheets, graphics, downloads and other original programme content remain the intellectual property of Move with Scoliosis unless otherwise stated.
Your purchase gives you a personal, non-transferable right to use the programme for your own private use.
You must not:
- copy or reproduce programme materials for others
- share your login details or programme access
- upload, publish or distribute programme videos or downloads
- use my materials to teach or train other people
- sell, sublicense or commercially exploit the programme or its contents
Downloadable materials may be retained and used by you personally in accordance with these Terms.
11. Technical Requirements and Availability
You are responsible for having:
- a suitable internet connection
- a device capable of accessing normal web-based video and PDF content
- suitable browser/software for viewing the programme
UK distance-selling rules require relevant information about the functionality and compatibility of digital content to be given to consumers where applicable. Legislation.gov.uk
I will take reasonable steps to keep the programme available during your applicable access period, but I cannot guarantee uninterrupted access at every moment.
Temporary interruption may occur due to maintenance, third-party platform problems, internet outages or circumstances outside my reasonable control.
If a significant problem on my side prevents access for a meaningful part of your paid access period, please contact me. I will take reasonable steps to resolve the problem and may extend access where appropriate.
12. Reasonable Changes to the Programme
I may make reasonable changes to Love Your Spine from time to time, for example to:
- correct errors
- update teaching or information
- improve accessibility or presentation
- improve technical functionality
- replace obsolete or unavailable material
Any changes will not materially reduce the programme you purchased or remove your statutory rights.
The Consumer Rights Act also protects consumers where digital content does not correspond with what was described or promised before purchase. Legislation.gov.uk
13. Personal Information
I may use your personal information to:
- process your purchase
- provide access to Love Your Spine
- send programme-related emails
- administer your account
- provide customer support
Programme-related emails are part of delivering Love Your Spine and are separate from general marketing communications.
Where you receive marketing emails, you can unsubscribe from those at any time.
Please see the Move with Scoliosis Privacy Policy for further information about how your personal data is handled.
14. Problems and Complaints
If you have a problem with your purchase, access or the programme, please contact me at:
I will aim to deal with any problem promptly and fairly.
Nothing in these Terms limits any statutory consumer rights available to you.
15. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence.
Subject to your statutory rights, I am not responsible for losses that:
- were not reasonably foreseeable when the contract was made
- were not caused by a breach on my part
- result from using the programme contrary to the guidance provided
- are business or commercial losses where the programme was purchased by you as a consumer for personal use
Nothing in this section excludes or restricts rights or remedies that cannot lawfully be excluded or restricted.
The Consumer Rights Act specifically prevents traders from contracting out of key statutory protections applying to digital content. Legislation.gov.uk
16. Misuse and Ending Access
I may suspend or terminate access if you materially breach these Terms, for example by:
- deliberately sharing your login with others
- unlawfully distributing programme content
- reproducing or selling programme material without permission
Where appropriate, I will contact you first and give you a reasonable opportunity to resolve the problem before ending access.
This does not affect either party's legal rights where immediate action is justified.
17. Governing Law and Disputes
These Terms are governed by the laws of England and Wales.
However, if you are a consumer living in another part of the UK or another country, you may also have mandatory consumer protections and rights concerning where legal proceedings can be brought.
Nothing in these Terms is intended to deprive you of mandatory rights available to you under the law that applies to you.
I would not use the older SHINE wording saying that the courts of England and Wales have “exclusive jurisdiction” for every customer. Current CMA guidance warns that terms which prevent consumers from bringing proceedings in courts available to them under applicable law may be unfair. GOV.UK
18. Entire Agreement
These Terms, together with:
- the Love Your Spine sales page
- information shown at checkout
- your order confirmation
- the Move with Scoliosis Privacy Policy
form the agreement relating to your purchase of Love Your Spine.
Nothing in these Terms excludes liability for any statement, representation or consumer right that cannot lawfully be excluded.
