Welcome

I’m so pleased you’ve decided to join one of my coaching programmes.
Before we get started, please take a moment to read these Terms and Conditions — they’re here to make sure we’re both clear about what’s included and how we’ll work together.

This agreement explains:

  • your legal rights and responsibilities,
  • my legal rights and responsibilities, and
  • key information required by law.

The aim is simple — to make things transparent, protect both of us, and take care of the practical side so we can focus on what really matters: your progress and well-being.

If anything is unclear, please contact me at info@movewithscoliosis.com before proceeding.

1. Who We Are

“I”, “me” or “my” means Marie Christine Jaureguiberry, trading as Move with Scoliosis.
“You” or “your” means the person purchasing or participating in a coaching programme.
“Services” means any 1:1 coaching programme, session, or related resources provided by Move with Scoliosis.

I am a sole trader operating from:
3 Foxglove Close, Chertsey, Surrey, KT16 8FD, United Kingdom.

2. Coaching Programmes Covered

These terms apply to:

  • 4-Month Coaching Programme (Signature Transformation)
  • 12-Month Coaching Programme (Year of Transformation)

Each programme includes:

  • Private sessions (via Zoom or in person),
  • Access to the SHINE Membership during your coaching period,
  • personalised practice plan with regular updates,
  • Form checks via video, and
  • Ongoing WhatsApp support for guidance between sessions.

3. When These Terms Apply

By signing up for one of my coaching programmes, you agree to be legally bound by these Terms and Conditions.

You also agree to:

  • my Website Terms of Use and Privacy Policy,
  • any extra written agreements or service outlines we’ve discussed, and
  • any specific programme description provided on my website or by email.

4. Booking & Payment

  • Programme fees can be paid in full upfront or in instalments as listed at the time of purchase.
  • Payments are due as scheduled — if a payment fails, access to sessions and materials may be paused until the balance is cleared.
  • All prices include VAT (where applicable).
  • Full payment (or the first instalment) must be received before your first session.

No-Refund Policy

Because of the preparation, time, and limited spaces involved, all payments are non-refundable, except:

  • if you are a consumer and cancel within your 14-day cooling-off period (see Section 8), or
  • if I cancel a programme before it begins.

Once we start working together, you’re responsible for the full programme fee, even if you decide not to complete all sessions.

5. Providing the Services

  • All 1:1 coaching sessions are held via Zoom or in person, depending on what we agree.
  • You’ll receive the Zoom link and scheduling details in advance.
  • If you need to reschedule, please give at least 24 hours’ notice.
  • Sessions cancelled with less notice, or missed without notice, will be charged in full.
  • Your programme must be completed within the agreed timeframe (4 or 12 months). Any unused sessions after that time will expire.
  • With your consent, sessions may be recorded for your personal reference. Recordings are kept securely and never shared publicly.
  • WhatsApp support is available throughout your programme for brief check-ins, accountability, and clarification — not for full coaching sessions. I aim to reply within 24–48 hours (Monday–Friday).
  • Occasionally, circumstances beyond my control (for example illness, travel, or technical issues) may delay or affect services. I’ll keep you informed and reschedule as soon as reasonably possible.

6. Your Responsibilities

  • You agree to attend sessions punctually and come prepared to engage fully in the process.
  • You’ll provide accurate information about your health and keep me informed of any changes that might affect your practice.
  • You understand that coaching is educational and supportive in nature — it is not medical treatment or therapy.
  • You’re responsible for implementing what you learn, and for your own decisions and actions between sessions.

7. About me:

I am a registered yoga teacher with Yoga Alliance Professionals UK, certified to teach Yoga for Scoliosis by Elise Browning Miller and Adelene Cheong, and have completed specialist scoliosis training with SSOL (Specialised Scoliosis Orthopaedic Learning) and APPI (Australian Physiotherapy & Pilates Institute).
My role is to provide education, guidance, and accountability — not medical advice or treatment.

8. Cooling-Off Period (Consumers Only)

If you are a consumer purchasing for personal use, you may cancel within 14 days of signing this agreement without giving a reason.

If you choose to start your coaching programme within that 14-day period (for example, by attending a session or accessing resources), you acknowledge that the service has begun and agree to pay for the portion already provided.

To cancel within the cooling-off period, please email info@movewithscoliosis.com.

Refunds (if applicable) will be processed using your original payment method.

9. Confidentiality

All information you share during sessions is treated as confidential, except where disclosure is required by law or necessary for your safety or that of others.

I will not share your personal information with third parties unless you agree.
You also agree to keep any materials or discussions from our work private and not to share them without consent.

10. Intellectual Property

All resources and materials provided (digital or printed) remain my intellectual property.
They are for your personal use only and must not be copied, shared, or distributed without my written permission.

11. Problems or Complaints

If something isn’t right, please contact me at info@movewithscoliosis.com so I can address it promptly and fairly.

Where appropriate, I may re-perform or adjust the service.
Nothing in this agreement affects your consumer rights under UK law.

12. Ending the Contract

  • Your coaching programme automatically ends at the end of your agreed 4- or 12-month period.

  • Either of us may end this agreement sooner if:

  • there’s a serious breach of these terms that isn’t resolved within 30 days of written notice, or

  • either party becomes or is likely to become insolvent.

  • I reserve the right to end the coaching relationship if I feel we are not a good fit. In that case, you’ll receive a partial refund for any sessions paid for but not yet delivered.

Ending this contract does not affect my right to receive outstanding payments.

13. Limiting My Liability

Except for liabilities that cannot be excluded by law (such as death or personal injury caused by negligence), I am not responsible for:

  • losses that were unforeseeable when we made this agreement,

  • losses not caused by my actions, or

  • business-related losses (e.g. income, opportunities, or time).

My total liability to you is limited to the total amount paid for the coaching programme.

14. Disputes

I aim to resolve any dispute quickly and respectfully.
If we cannot resolve it informally, either of us may take the matter to court.

  • The courts of England and Wales have exclusive jurisdiction.

  • The laws of England and Wales apply.

  • We both agree not to post or share negative or disparaging comments about each other online, even in the event of a dispute.

15. Entire Agreement

These Terms & Conditions form the entire agreement between us.
You confirm you haven’t relied on any statements outside this document when deciding to purchase.

16. Third-Party Rights

No one other than you and I has any rights to enforce any part of this agreement.
