Welcome
I’m so pleased you’ve decided to use my services or resources.
Before we get started, please take a moment to read these important Terms and Conditions.
This agreement explains:
- your legal rights and responsibilities,
- my legal rights and responsibilities, and
- key information required by law.
The aim is simple — to make things clear, protect both of us, and take care of the business side so we can focus on what really matters: helping you move, feel, and live better.
If anything is unclear, please contact me at info@movewithscoliosis.com before proceeding.
1. Who We Are
“I”, “me” or “my” means Marie Christine Jaureguiberry, trading as Move with Scoliosis.
“You” or “your” means the person buying or using my services or resources.
“Services” include all memberships (including SHINE and SHINE Lite), classes, workshops, courses, and digital resources provided by Move with Scoliosis.
I am a sole trader operating from:
3 Foxglove Close, Chertsey, Surrey, KT16 8FD, United Kingdom.
2. When These Terms Apply
By signing up for any of my classes, memberships, or services, you agree to be legally bound by these Terms and Conditions.
If you use any of my free resources (for example podcasts, webinars, discovery sessions, or free downloads), these terms still apply, except for the sections on payment and consumer rights.
You also agree to:
- my Website Terms of Use and Privacy Policy,
- any extra written agreements between us, and
- specific descriptions for your chosen service (for example, a course or membership page).
3. Information I Provide
UK consumer law requires me to give you certain key details before we make a binding agreement. You’ll receive this information in this document or in your service description.
This includes:
- what the service includes,
- who I am and how to contact me,
- the price and payment arrangements,
- delivery or access details,
- your cancellation rights, and
- how to make a complaint.
4. Providing the Services
- All SHINE and SHINE Lite classes take place live via Zoom, and you’ll receive the sign-in link by email before each class.
- Services are delivered within the timeframe outlined in your membership or course description.
- If you can’t attend a live class, you’ll have access to the recording in your member portal for four weeks after the class.
- All live sessions are recorded for member access and quality purposes. By attending, you agree that your image and voice may appear in the recording. Recordings are only shared within the membership portal and are never made public without your consent.
- Occasionally, circumstances beyond my control (for example, illness, technical issues, or government restrictions) may delay services. I’ll always keep you informed and resume as soon as possible.
- If any in-person event ever needs to move online, I reserve the right to make that change.
5. Your Responsibilities
- You agree to pay the fees outlined in your chosen programme or membership.
- Please provide full and accurate health information so I can guide you safely.
- We’ll agree on a suitable communication method between sessions.
- My classes and memberships are not therapy or counselling. Results depend on your personal commitment and consistency.
About me:
I am a registered yoga teacher with Yoga Alliance Professionals UK, certified to teach Yoga for Scoliosis by Elise Browning Miller and Adelene Cheong, and have completed specialist scoliosis training with SSOL (Specialised Scoliosis Orthopaedic Learning) and APPI (Australian Physiotherapy & Pilates Institute).
My role is to provide education and guidance, not medical treatment.
Health disclaimer:
Exercise carries some risk. Please consult your GP before beginning any exercise programme.
You are responsible for choosing movements suitable for your body and adjusting where needed.
Please keep me informed of any changes to your health or personal circumstances that could affect your practice.
6. Charges and Payment
- All prices include VAT (where applicable).
- Full payment is required in advance.
- Fees are non-refundable, except if:
- you are a consumer and cancel within your 14-day cooling-off period (see Section 7),
- I cancel a programme or class, or
- you cancel with at least 14 days’ written notice (a partial refund may apply minus reasonable costs).
SHINE & SHINE Lite Memberships
- Both memberships renew automatically each month.
- You can cancel any time before your next billing date — access remains active until the end of your current paid month.
- No partial refunds are issued for unused time.
- SHINE includes live classes, recordings, and added features.
- SHINE Lite includes the pre-recorded video library (5–60 mins), curve-specific sessions, guided meditations, selected workshop recordings, and access to the private Facebook group.
- The same payment, renewal, and cancellation terms apply to both.
Outside these situations, payments are non-refundable. This is because payment covers the full programme, not individual sessions, and spaces are limited.
Payments can be made via the website or as otherwise agreed.
7. Cooling-Off Period (Consumers Only)
If you’re a consumer, you may cancel this contract within 14 days without giving a reason, starting from the day the contract begins.
If you ask me to start providing services during this period (for example, by joining a live class, downloading materials, or entering the Facebook group), you agree to waive your right to a full refund for the portion of services already delivered.
Digital downloads and recordings are non-refundable once accessed unless faulty.
To cancel, email info@movewithscoliosis.com.
8. Intellectual Property
All materials I provide (digital or printed) remain my intellectual property.
You may use them for personal use only and must not copy, share, or distribute them without my written permission.
9. Personal Information
I use your information to:
- deliver the services,
- process payments, and
- send updates about my offerings (you can unsubscribe anytime).
I will never share your information without consent unless required by law.
Please review my Privacy Policy for full details.
10. Confidentiality
- Information shared privately in classes or sessions is confidential, except where disclosure is required by law or necessary for your safety.
- When attending group classes or online sessions, please respect others’ privacy and keep shared information confidential.
- These obligations remain in place even after our work together ends.
11. Problems or Complaints
If something isn’t right, please contact me as soon as possible at info@movewithscoliosis.com so I can address it quickly and fairly.
If appropriate, I may re-perform or adjust the service.
Nothing in this agreement affects your consumer rights under UK law.
12. Ending the Contract
- Fixed-term services end automatically at the end of the agreed timeframe.
- Ongoing services (like SHINE memberships) can be ended by either party with one month’s written notice.
- Either of us may end this agreement immediately if:
- there’s a serious breach not resolved within 30 days of written notice, or
- either party becomes or is likely to become insolvent.
- I may also end our agreement if I feel we’re not the right fit, in which case you’ll receive a partial refund for any prepaid sessions not yet delivered.
13. Limiting My Liability
Except for liabilities that can’t be excluded by law (such as death or personal injury due to negligence), I am not responsible for:
- losses that were unforeseeable when we agreed,
- losses not caused by my actions, or
- business-related losses (e.g. income or time).
My total liability is limited to the amount you’ve paid for the service.
14. Disputes
I aim to resolve any dispute quickly and respectfully.
If that isn’t possible, either of us may take the matter to court.
- The courts of England and Wales have exclusive jurisdiction.
- The laws of England and Wales apply.
- We both agree not to post or share negative comments about each other online, even in the event of a dispute.
15. Entire Agreement
These Terms & Conditions are the entire agreement between us.
You confirm you haven’t relied on any statements outside this document when deciding to purchase.
16. Third-Party Rights
No one other than you and I has any rights to enforce any part of this agreement.
